Peraturan Dewan Pers
PEDOMAN PEMBERITAAN MEDIA SIBER
Kemerdekaan berpendapat, kemerdekaan berekspresi, dan kemerdekaan pers adalah hak asasi manusia yang dilindungi Pancasila, Undang-Undang Dasar 1945, dan Deklarasi Universal Hak Asasi Manusia PBB. Keberadaan media siber di Indonesia juga merupakan bagian dari kemerdekaan berpendapat, kemerdekaan berekspresi, dan kemerdekaan pers.
Media siber memiliki karakter khusus sehingga memerlukan pedoman agar pengelolaannya dapat dilaksanakan secara profesional, memenuhi fungsi, hak, dan kewajibannya sesuai Undang-Undang Nomor 40 Tahun 1999 tentang Pers dan Kode Etik Jurnalistik. Untuk itu Dewan Pers bersama organisasi pers, pengelola media siber, dan masyarakat menyusun Pedoman Pemberitaan Media Siber sebagai berikut:
Ruang Lingkup
a.Media Siber adalah segala bentuk media yang menggunakan wahana internet dan melaksanakan kegiatan jurnalistik, serta memenuhi persyaratan Undang-Undang Pers dan Standar Perusahaan Pers yang ditetapkan Dewan Pers.
b.Isi Buatan Pengguna (User Generated Content) adalah segala isi yang dibuat dan atau dipublikasikan oleh pengguna media siber, antara lain, artikel, gambar, komentar, suara, video dan berbagai bentuk unggahan yang melekat pada media siber, seperti blog, forum, komentar pembaca atau pemirsa, dan bentuk lain.
Verifikasi dan keberimbangan berita
a. Pada prinsipnya setiap berita harus melalui verifikasi.
b. Berita yang dapat merugikan pihak lain memerlukan verifikasi pada berita yang sama untuk memenuhi prinsip akurasi dan keberimbangan.
c. Ketentuan dalam butir (a) di atas dikecualikan, dengan syarat:
– Berita benar-benar mengandung kepentingan publik yang bersifat mendesak;
– Sumber berita yang pertama adalah sumber yang jelas disebutkan identitasnya, kredibel dan kompeten;
– Subyek berita yang harus dikonfirmasi tidak diketahui keberadaannya dan atau tidak dapat diwawancarai;
d. Media memberikan penjelasan kepada pembaca bahwa berita tersebut masih memerlukan verifikasi lebih lanjut yang diupayakan dalam waktu secepatnya.
e. Penjelasan dimuat pada bagian akhir dari berita yang sama, di dalam kurung dan menggunakan huruf miring.
f. Setelah memuat berita sesuai dengan butir (c), media wajib meneruskan upaya verifikasi, dan setelah verifikasi didapatkan, hasil verifikasi dicantumkan pada berita pemutakhiran (update) dengan tautan pada berita yang belum terverifikasi.
Isi Buatan Pengguna (User Generated Content)
a. Media siber wajib mencantumkan syarat dan ketentuan mengenai Isi Buatan Pengguna yang tidak bertentangan dengan Undang-Undang No. 40 tahun 1999 tentang Pers dan Kode Etik Jurnalistik, yang ditempatkan secara terang dan jelas.
b. Media siber mewajibkan setiap pengguna untuk melakukan registrasi keanggotaan dan melakukan proses log-in terlebih dahulu untuk dapat mempublikasikan semua bentuk Isi Buatan Pengguna. Ketentuan mengenai log-in akan diatur lebih lanjut.
- Tidak memuat isi bohong, fitnah, sadis dan cabul;
- Tidak memuat isi yang mengandung prasangka dan kebencian terkait dengan suku, agama, ras, dan antargolongan (SARA), serta menganjurkan tindakan kekerasan;
- Tidak memuat isi diskriminatif atas dasar perbedaan jenis kelamin dan bahasa, serta tidak merendahkan martabat orang lemah, miskin, sakit, cacat jiwa, atau cacat jasmani.
- – Tanggung jawab media siber pembuat berita terbatas pada berita yang dipublikasikan di media siber tersebut atau media siber yang berada di bawah otoritas teknisnya;
- – Koreksi berita yang dilakukan oleh sebuah media siber, juga harus dilakukan oleh media siber lain yang mengutip berita dari media siber yang dikoreksi itu;
- – Media yang menyebarluaskan berita dari sebuah media siber dan tidak melakukan koreksi atas berita sesuai yang dilakukan oleh media siber pemilik dan atau pembuat berita tersebut, bertanggung jawab penuh atas semua akibat hukum dari berita yang tidak dikoreksinya itu.
- – Sesuai dengan Undang-Undang Pers, media siber yang tidak melayani hak jawab dapat dijatuhi sanksi hukum pidana denda paling banyak Rp500.000.000 (Lima ratus juta rupiah).

Cyber Media Coverage Guidelines
Scope
1. Cyber media are all forms of media
which using the internet and carry out journalistic activities, and fulfil the
requirements of the Press Law and Press Company Standards set by the Press
Council.
2. User Generated Content is all content
created and or published by cyber media users, including articles, pictures,
comments, audios, videos and various forms of uploads attached to cyber media,
such as blogs, forums, reader’s comments. or viewers, and other forms.
News
verification and balance
1. Essentially every news must be
verified.
2. News that can harm other parties
requires verification on the same news to meet the principles of accuracy and
balance.
3. The provisions in point (a) above are
excluded, with conditions:
o News really contains urgent public
interest;
o The first news sources are sources that
are clearly identified, credible and competent;
o The subject of the news that must be
confirmed is unknown and or cannot be interviewed;
4. The media explained to the readers that
the news still needed further verification which was sought as soon as
possible.
5. Explanations are included at the end of
the same story, in brackets and in italics.
6. After loading the news in accordance
with point (c), the media is obliged to continue verification efforts, and
after verification is obtained, the verification results are included in the
update news with a link to the news that has not been verified.
User
Generated Content
1. Cyber media must include terms and
conditions regarding User Generated Content that does not conflict with Law no.
40 of 1999 concerning the Press and the Journalistic Code of Ethics, which are
clearly and incisively placed.
2. Cyber media requires each user to
register for membership and perform a log-in process first to be able to
publish all forms of User Generated Content. Provisions regarding log-in will
be further regulated.
3. In the registration, cyber media
requires users to give written consent that the published User Generated
Content:
o Does not contain lies, slander,
sadistic and obscene contents;
o Does not contain content that contains
prejudice and hatred related to ethnicity, religion, race, and intergroup
(SARA), and encourages acts of violence;
o Does not contain discriminatory content
on the basis of gender and language differences, and does not demean the weak,
poor, sick, mental disorder, or physically disabled.
4. Cyber media has absolute authority to
edit or delete User Generated Content that is contrary to item (c).
5. Cyber media is required to provide a
complaint mechanism for User Generated Content that is deemed to have violated
the provisions in point (c). The mechanism should be provided in a place that
is easily accessible to users.
6. Cyber media is obliged to edit, delete,
and take corrective action for any User Generated Content that is reported and
violates the provisions of point (c), as soon as possible proportionally no
later than 2 x 24 hours after the complaint is received.
7. Cyber media that have complied with the
provisions in points (a), (b), (c), and (f) are not responsible for problems
caused by loading content that violates the provisions in point (c).
8. Cyber media is responsible for User
Generated Content that is reported if it does not take corrective action after
the time limit as stated in point (f).
Errors,
Corrections, and Right of Reply
1. Errors, corrections, and right of reply
refer to the Press Law, Journalistic Code of Ethics, and Guidelines for Right
of Reply set by the Press Council.
2. Errors, corrections and or the right to
reply must be linked to the news that is rectified, corrected or given the
right to reply.
3. In every report on errata, correction,
and right to reply, it is obligatory to state the time of loading of the
errata, correction, and/or right of reply.
4. If a certain cyber media news is
disseminated by other cyber media, then:
a. The responsibility of the cyber media
that produces news is limited to the news published in the cyber media or cyber
media under its technical authority;
b. News corrections made by a cyber media
must also be carried out by other cyber media citing news from the corrected
cyber media;
c. Media that disseminate news from a
cyber media and do not make corrections to the news according to the cyber
media owner and or news maker, are fully responsible for all legal consequences
of the news that is not corrected.
d. In accordance with the Press Law, cyber
media that do not serve the right of reply may be subject to criminal sanctions
of a maximum fine of Rp. 500,000,000.
News
Revocation
1. News that has been published cannot be
revoked for reasons of censorship from outside the editor, except for issues
related to SARA, morality, the future of children, traumatic experiences of
victims or based on other special considerations determined by the Press
Council.
2. Other cyber media must follow the
revocation of news quotes from the original media that have been revoked.
3. The revocation of news must be
accompanied by the reasons for the revocation and announced to the public.
Advertisement
1. Cyber media must clearly distinguish
between news products and advertisements.
2. Every news/article/content that is an
advertisement and or paid content must include a description, advertorial, ads
sponsored., or other words that explain that the news/article/content is an
advertisement.
Copyright
Cyber media must respect copyright as regulated in the
applicable laws and regulations.
Inclusion
of Guidelines
Cyber media must include these Cyber Media Coverage
Guidelines in their media clearly and incisively.
Dispute
The final assessment of the dispute regarding the
implementation of this Cyber Media Coverage Guidelines is resolved by the Press
Council.
